Terms & Conditions
Please read our terms and conditions carefully. It contains information
regarding your rights as a customer, as well as limitations and exclusions
that apply to you.
Clear Stream Monuments is owned by Clear Stream Group, LLC, and is registered
in the state of Wyoming, USA.
By using ClearStreamMonuments.com web site and/or purchasing from Clear
Stream Monuments the customer agrees to be bound by and accept the Terms
and Conditions contained herein.
Hereinafter Clear Stream Monuments will be referred to as CSM.
1. ORDER ACCEPTANCE POLICY:
CSM has the sole discretion to accept or decline a customers order for
reasonable cause including but not limited to merchandise being out of
stock, or failure by customer to satisfy the payment terms of CSM. If
CSM has listed a product on its web site at an incorrect price due to
a typographical error or an error by our suppliers when providing pricing
to us. CSM has the right to cancel or refuse any order that was incorrectly
priced. CSM shall contact the customer and notify them of the error. If
payment has been remitted customer has the right to select an alternative
monument or request a full refund of the remitted funds.
2. PAYMENT TERMS:
Payment for CSM's products will be made by credit card, bank wire transfer,
check, or money order, or by some other method approved by CSM. Payment
in full must be received by CSM prior to CMS's acceptance of the order.
All prices listed on CSM's web site are in US Dollars.
3 TAXES:
Sales tax will be added to orders placed in the state of Wyoming, USA.
4. QUOTATION TERMS:
Any quotations for products provided by CSM will be valid for a period
of ten (10) days. CSM has the right to adjust or cancel quotations as
required.
5. CANCELLATIONS:
All product orders placed by you the customer with CSM may be canceled
within three (3) business days of placing your order and a full refund
of your money will be issued. After three (3) business days all sales
are final.
6. SHIPPING:
CSM shall pay shipping costs for headstones and cemetery markers delivered
in the continental United States (48 states). The customer is responsible
for shipping costs for mausoleums, columbariums, statues, benches, urns,
and vases delivered in the continental United States (48 states). The
customer is responsible for shipping costs for all products shipped to
Alaska, Hawaii, Canada, Mexico or any other country. Shipping rates quoted
by CSM are for pickup and delivery, and standard ground transportation.
CSM is not liable for incorrect shipping quotes due to typographical error
or error in pricing information provided by our shipping/delivery carriers.
CSM has the right to refuse, cancel, or adjust any orders due to shipping
price errors and will refund any remitted customer funds.
All shipped products are insured to protect you. This insurance will
cover any damage that may occur during shipment of the product to the
customer. The customer is responsible for inspecting freight for missing
items or signs of damage upon receipt of goods. Prior to signing for receipt
of goods it is the customers responsibility to check the memorial for
any signs of damage. All freight, loss, and damage claims must be filed
with the shippers insurance company within ten (10) days from the date
the shipment was received. Failure to do so may cause the Insurance Company
to deny the claim. If damage has occurred, please contact
CSM for further instructions. We will assist you in filing
the insurance claim.
7. TRANSFER OF TITLE:
Title to products purchased from CSM passes to the customer upon completion
of delivery to the address provided by the customer.
8. CEMETERY ACCEPTANCE:
CSM requires signed approval from the cemetery before we start production
of your memorial. CSM will contact the cemetery to confirm that the memorial
you purchased/ordered meets the cemetery regulations and restrictions.
If the memorial does not meet the cemetery's regulations we will notify
you, and provide you with alternatives that do meet the cemetery regulations.
If you are not satisfied with the proposed alternative memorial we will
refund your money.
9. CEMETERY FEES:
CSM is not responsible for any cemetery fees or installation charges.
The prices listed on CSM's web site do not include installation or cemetery
fees.
10. NATURAL ORGANIC MATERIALS:
The customer acknowledges that stone, granite, and marble are natural
organic materials with variations in color and other inherent characteristics
and agrees to accept these natural variations in the material.
11. WARRANTY:
Clear Stream Monuments offers a warranty for each product we sell. Clear
Stream Monuments makes no express warranties except those stated herein.
Lifetime Warranty:
Every cemetery marker, bench, granite headstone, granite monument, mausoleum,
columbarium, and granite statue sold by Clear Stream Monuments is guaranteed
for life not to crack or fracture as a result of exposure to outdoor conditions
and weather. If it cracks or falls apart Clear Stream Monuments will repair
or replace it without charge. This warranty is valid in perpetuity and
becomes effective upon delivery of the memorial purchased.
Limited Warranty:
Clear Stream Monuments provides a Limited Warranty on: marble statues,
marble headstones, vases, urns, and porcelain photos. This warranty is
limited to these products being delivered free of defects. If litho paint
is used in/on letters or carvings, this paint is warranted to be free
of defects at the time the memorial is delivered.
CSM's products are Guaranteed to be free from defects in Finish and Craftsmanship.
Every product (marker, monument, headstone, bench, columbarium, mausoleum,
statue, urn, vase) sold by CSM goes through a Quality Assurance Inspection
prior to being shipped. If at the time of delivery you find a defect in
the finished material or craftsmanship of our product it will be repaired
or replaced at no cost to you. If you find a defect you must file a claim
with CSM Customer Service department within ten (10) days from date of
delivery in order for this warranty to be valid. CSM may require a written
explanation of the defect and a photograph or digital image of the defective
product.
CSM Guarantees the marker, monument, headstone, bench, columbarium, mausoleum,
or urn will be free from Errors. We take every necessary precaution to
ensure that your product is shipped exactly as you ordered. We confirm
with you that all the information on the memorial/monument is exactly
as you ordered prior to production. If you receive your memorial/monument
with errors that were made by us we will correct or replace it at no cost
to you. If you discover that you have made an error when placing your
order we will do our best to help you fix it. CSM may require a written
explanation of the Error and a photograph or digital image of the Error
on the product.
If your memorial/monument is vandalized or destroyed by an act of nature
we will replace if for you at our cost (no profit). Please keep records
of your purchase from CSM including approved sketches/drawings. We may
need this information in order to recreate your monument.
12. INSURANCE:
All shipped products are insured to protect you. This insurance will cover
any damage that may occur during shipment of the product to the customer.
The customer is responsible for inspecting freight for missing items or
signs of damage upon receipt of goods. Prior to signing for receipt of
goods it is the customers responsibility to check the memorial for any

13. RETURNS:
Due to the custom nature of the products we sell, all sales are final.
We take every necessary precaution to ensure that your product is shipped
exactly as you ordered. We confirm with you that all the information on
the memorial/monument is exactly as you ordered prior to production. We
verify with the cemetery that the memorial/monument meet their regulations
and restrictions. If you have a defective product please refer to the
product warranty for available remedies offered by CSM.
14. PRIVACY POLICY:
CSM is committed to protecting your online privacy. We feel it is important
for you to know how we handle the information we receive from you via
the Internet. You can visit www.ClearStreamMonuments.com without revealing
any personal information. However, you are required to provide personal
information to purchase products from our web site. CSM'S Privacy Policy
is an integral part of our Terms and Conditions. You are encouraged to
read our entire privacy policy.
15. LIMITATION OF LIABILITY:
CSM is not responsible for any liability beyond the remedies written herein.
CSM will not be liable for any amount of damages above the dollar amount
paid by the customer for purchases from CSM.
16. GOVERNING LAW:
By purchasing from CSM customer agrees that all purchases will be governed
by the laws of the State of Wyoming, USA.
17. ARBITRATION:
Any dispute arising from the use of CSM's web site or the products purchased
from our web site shall be submitted to arbitration for resolution in
Cheyenne, Wyoming, USA.
18. TERMS OF USE:
Your use of the CSM web site constitutes your acceptance of the Terms
and Conditions listed herein. The Terms and Conditions are subject to
change without prior notice at any time at CSM's sole discretion.
